Terms of Service (ToS)
Client Terms of Service
Before the first session we require a credit card on file (unless you have already purchased a pre-paid package). An initial deposit of $100 is required for the first hour.
Pay-As-You-Go
We will be sending you an invoice to the email address you have provided on the 15th and last of every month for the hours that you have accrued during that pay period. The invoice includes a PayPal link through which you can instantly pay.
Most people prefer the convenience of automatic credit card payments. We process automatic credit card payments two days after sending invoices, on the 17th and 2nd of each month. If you have any dispute about the amount processed on an automatic credit payment please call us at 747-444-9907 and we will be more than happy to resolve the issue. If we are not able to satisfactorily resolve the issue, both you (the client) and we (the company) agree to your credit card company’s dispute resolution policies.
Whether you choose to pay through PayPal or by credit card, a credit card is required on file.
Pre-Paid Packages
If you opt for a pre-paid package, we will invoice you for the full package amount. You can pay by credit card, PayPal, or you can mail a check to:

Due to scheduling and ensuring a tutor is available for you, packages must be completely used within one (1) year from date of purchase in order to be honored.
Past Due Policy and Late Fees
We will be billing you on the 15th and last of every month for the hours that you have accrued during that pay period. In the event that your credit card is denied we will assess the following late fees:
Late Fee Schedule
1 month past due $25
2 months past due $50
3 months past due The account will be referred to collections.
Cancellation
We require 24 hours cancellation notice
We understand that sometimes things come up. If you need to cancel a session we ask that you give your tutor 24 hours notice. Without 24-hour notice a 1-hour session fee will be applied to your account.
In the event of an emergency, please give us a call. We are often willing to waive the cancellation fee in the event of an emergency.
Reasonable Protection
We want to make sure that the learning environment is safe for both your student and our tutor. If the tutoring sessions will be taking place in your home we require that you provide a safe environment for the tutor. The environment must be free of structural, electrical, and chemical hazards.
To protect our tutors we do not allow them to drive your student in their vehicle, or to cook food or bring food to your student. Please do not ask the tutor to drive, cook food, or bring food.
Release of Liability
We have extensively interviewed and background checked your tutor. We are confident that we are sending you a great tutor, but we cannot guarantee his or her behavior during the tutoring session. You can not hold Tried & True Tutoring responsible for the actions of the tutor. In the event that your tutor commits a crime, the tutor may be held personally liable, but Tried & True Tutoring can not be sued. As an independent contractor, the tutor is solely liable for his/her actions. By signing this agreement, you are releasing us of any liability. You can request a copy of the tutor’s background check for $30. You will first be required to sign and return a request to view background check document.
Term of the Agreement
Either party can choose to terminate the Client Agreement at any time. If you terminate the agreement, you will still be responsible for any balance that you may owe. If we terminate the agreement, and we still owe you hours for pre-paid sessions, we will either complete those pre-paid sessions as agreed upon, or we will refund the money paid for non-serviced sessions within 7-10 business days.
The unused hours purchased in a package expire after 1 year from the date of purchase. If you have not used the hours purchased in a package within 1 year from the date of purchase, these hours will expire and are not refundable.
You can not hire the tutor we have provided independently of Tried & True Tutoring for one year from the date of termination of the Client Agreement. The hiring, reference and background checking, and training of tutors comes at great expense to Tried & True Tutoring. This hiring and training process allows us to offer you highly qualified and vetted tutors. If you terminate this agreement, yet you wish to continue working with the tutor we have provided, you will be required to wait 1 full year from the termination of this agreement.
Good Faith
Tried & True Tutoring believes that it is offering you a top quality tutor in good faith. We spend a lot of time and money making sure that your tutor is of the highest quality. We want to do whatever it takes to make your student succeed and to make you happy. If there is anything we can do to improve your service, we will. We are often willing to be flexible about the terms of this agreement. We believe that you are, in good faith, only interested in what is best for your student. We are, in good faith, providing the best tutors possible. Having said that, this Client Agreement is a legally binding Contract, so in the event of a dispute both parties agree to abide by the terms of this Contract.
